The court once more denies Abba Kyari bail
The bail application submitted by suspended deputy commissioner of police Abba Kyari and three others was once more rejected by the Federal High Court of Abuja.In their bail application, Kyari and the other three defendants had contended that fresh evidence surrounding the Kuje Prison Break and an alleged threat to their life called for a new application.
The NDLEA objected, claiming that they had not shown how the new problems would prevent them from jumping ship.
In his ruling on the bail application this morning, Justice Emeka Nwite concurred with the NDLEA legal team that the accused have not shown that they won’t violate their release conditions and obstruct the criminal justice system. The court ruled that a risk to life in a jail or prison is not a consideration when deciding whether to grant bail.
In its rebuttal affidavit, the prosecution said that Mr. Kyari and his co-defendants pose a flight risk because they might tamper with the money laundering investigations and the witnesses scheduled to testify at the trial.
The court had already reached a ruling regarding the defendants’ bail, and nothing had been brought before the court to cause it to rethink its previous decision.
